1. Purpose
These Terms of Service (ToS) define the terms and conditions for using the Kiweal platform, a marketplace specialized in buying and selling graded collectible cards.
By using our platform, you agree to these Terms without reservation.
2. Definitions
- Kiweal: The company publishing the platform.
- Seller: User listing cards for sale on the platform.
- Buyer: User acquiring cards on the platform.
- Graded Card: Collectible card authenticated and rated by a third-party organization (PSA, BGS, CGC, etc.).
3. How the Marketplace Works
3.1 Kiweal's Role
Kiweal acts as a trusted third party between buyers and sellers:
- Matchmaking: We connect buyers and sellers through a Bid/Ask system.
- Physical Verification: Every card sold transitions through Kiweal's premises for physical verification before being shipped to the Buyer.
3.2 Purchase and Escrow
Upon purchase, funds are collected by Stripe and held in escrow by Kiweal until the transaction is validated (after physical verification).
4. Fees and Commissions
Kiweal charges a commission on each finalized sale. Service fees are calculated as follows:
- Selling: 8% of the sale price (including commission and transaction fees).
- Buying: Displayed price + 2% protection fee (max 15€) + shipping fees.
4.1 Geographical Restrictions
The Service is currently available for deliveries to mainland France only (Corsica included). Orders to overseas territories (DOM-TOM) or abroad cannot be processed.
5. Registration and Account
Using Kiweal requires creating a personal account and identity verification (KYC) via Stripe Identity for sellers. The user agrees to provide truthful information.
6. User Obligations
Users are prohibited from:
- Any attempt to manipulate prices.
- Circumventing the platform to finalize a sale.
- Selling counterfeit cards or cards with altered cases.
7. Disputes and Claims
In the event of non-compliance found during Kiweal's verification, the sale is cancelled and the Buyer is fully refunded. Buyers have 21 days after receipt to report any latent defects.
8. Liability
Kiweal commits to verifying each card but cannot be held responsible for original grading errors by organizations (PSA, etc.) or damages caused by the carrier beyond insurance limits.
9. Intellectual Property
All site elements are protected under copyright law. Mentioned trademarks (Pokémon, etc.) remain the property of their respective owners.
10. Data Protection
Your data is processed in accordance with our privacy policy.
11. Changes to Terms
Kiweal may modify the ToS at any time. You will be notified by email of any major changes.
12. Governing Law
These ToS are governed by French law. Any dispute relating to their interpretation will be subject to the competent courts of Reims, France.
