1. Purpose
These Terms of Service govern the use of Kiweal (kiweal.com), a marketplace for graded trading cards.
By using our platform, you agree to these Terms without reservation.
2. Definitions
- Kiweal: The platform and its operator
- User: Any person browsing the site
- Seller: User listing cards for sale
- Buyer: User purchasing cards
- Graded card: Trading card encapsulated and rated by a certification company (PSA, CGC, BGS, etc.)
3. How the Marketplace Works
3.1 Kiweal's Role
Kiweal acts as a trusted third party between buyers and sellers:
- Matchmaking: We connect buyers and sellers through a Bid/Ask system
- Payment security: Funds are held in escrow until verification
- Authentication: Every card passes through our facility for verification before shipping to the buyer
3.2 Transaction Process
- Seller creates a listing (Ask) or buyer makes an offer (Bid)
- When a match occurs, the buyer pays the total amount
- Seller ships the card to Kiweal
- Kiweal verifies authenticity and condition
- If approved, Kiweal ships to the buyer and releases funds to the seller
- If not compliant, the card is returned to the seller and the buyer is refunded
3.3 Authentication
Kiweal verifies:
- Integrity of the certification case
- Certificate number match
- Advertised grade
- No visible damage
Important: Kiweal does not re-grade cards. We verify compliance with the listing.
4. Fees and Commissions
- Seller commission: 5% of sale price
- Buyer fee: 3% of purchase price
- Payment processing: Included (Stripe)
Shipping fees are paid by the buyer and calculated based on the carrier.
5. Registration and Account
5.1 Registration Requirements
- Be at least 18 years old
- Provide accurate and up-to-date information
- Have a valid email address
5.2 Identity Verification (KYC)
To buy or sell, identity verification via Stripe Identity is required. This verification is mandatory to:
- Protect against fraud
- Comply with anti-money laundering regulations
5.3 Seller Account
Sellers must:
- Complete KYC verification
- Provide a valid IBAN to receive payments
- Respect shipping deadlines (5 business days after match)
6. User Obligations
6.1 Sellers
- Only list authentic cards that match the description
- Ship within deadlines (5 business days)
- Package cards carefully to prevent damage
- Use a tracked shipping service
6.2 Buyers
- Pay within the allotted time (15 minutes after match)
- Confirm receipt of the card
- Report any issues within 21 days of receipt
7. Disputes and Claims
7.1 Dispute Window
Buyers have 21 days after receipt to report an issue.
7.2 Procedure
- Contact support@kiweal.com with details and photos
- Kiweal reviews the dispute within 5 business days
- Decision: refund, return, or claim rejection
7.3 Refund Cases
- Card not matching the listing (wrong card, wrong grade)
- Card damaged during shipping
- Counterfeit card
7.4 Exclusions
- Disagreement on condition (if matching description)
- Change of mind after purchase
- Damage caused by buyer after receipt
8. Liability
8.1 Kiweal's Responsibility
Kiweal commits to:
- Verify each card before final shipment
- Secure financial transactions
- Handle disputes in good faith
Kiweal cannot be held responsible for:
- Grading errors by certification companies
- Shipping delays caused by carriers
- Loss or theft after confirmed delivery
8.2 Insurance
Shipments are insured up to the declared card value, within carrier limits.
9. Intellectual Property
Card images come from public databases (TCGdex) or are provided by sellers. Kiweal respects the intellectual property rights of trading card publishers.
10. Data Protection
Your personal data is processed in accordance with our Privacy Policy and GDPR.
11. Changes to Terms
Kiweal reserves the right to modify these Terms. Users will be notified by email of any significant changes. Continued use of the site after modification constitutes acceptance.
12. Governing Law
These Terms are governed by French law. In case of dispute, the courts of Reims, France shall have jurisdiction.
